Peter Pan Bus Lines, Inc. (“Peter Pan”, “we”, “us” or “our”) is committed to respecting your privacy.  This Privacy Policy explains our practices regarding the collection, use, and disclosure of information that you (“you” or “user”) may provide to us through your use of our websites at https://peterpanbus.com/, https://www.peterpancharters.com/, and all of their sub-domains (collectively, the “Websites”), our mobile application made available for download to your device (the “App”), the platform we make available through the Websites and App (the “Platform”), when you purchase and use transportation services from Peter Pan (the “Transportation Services”), and the internet service we provide to travelers in some terminals and on our coach buses (the “Internet Service”, which together with the Websites, App, Platform, and Transportation Services, as well as any related services, social media pages, and applications, referred to individually and collectively as our “Services” as applicable below).

By clicking on an “accept” button, creating an account, or otherwise visiting, accessing, and/or using our Services, you agree to be bound by this Privacy Policy and our Terms of Service.  If you do not agree to the terms of this Privacy Policy AND OUR TERMS OF SERVICE, please do not VISIT, REGISTER FOR, ACCESS, AND/OR use the Services.   Each time you use the Services, the current versions of this Privacy Policy AND OUR TERMS OF SERVICE will apply.  

INFORMATION WE COLLECT

We collect two types of information from users of our Services: “Personal Information,” which is information that can be used to identify you (such as your name or your email address), and “Aggregate Information,” which is information that cannot be used to identify you (such as frequency of visits to the Websites or your browser type).

INFORMATION YOU PROVIDE TO US

We collect Personal Information that you voluntarily provide to us when you use our Services, such as when you register for a Perks Account (as described in more detail below), when you purchase a ticket for transportation services or request a quotation for our charter services, when you access the Internet Service we make available, when you submit an online form through our Websites or App, or when you send us an email.  You may provide us Personal Information such as your name, e-mail address, physical address, and phone number, among other information requested from you. 

ACCOUNT INFORMATION

In order to set up an account to use the Platform through our Websites or App (a “Perks Account”), you must first complete a registration process with Peter Pan and provide Personal Information such as first and last name, email address, and phone number.  Any Personal Information you share with Peter Pan as part of the account registration process may be used by Peter Pan to manage your ticket purchases and account, and to provide Services to you. 

MARKETING & SOCIAL MEDIA

If you opt in to receive marketing communications from Peter Pan, you are signing up to receive updates, marketing communications, and other information about Peter Pan, our Services, and our products, promotions, and our Websites and App.

If you interact with us on social media, we may collect your social media profile information, your communications with us, and your communications and your posts on our social media pages.

PAYMENT PROCESSING

We work with third-party payment processors to process ticket purchases and orders for Peter Pan merchandise through the Websites and App.  Your bank account and/or credit or debit card information is never shared with us, and at no point in any transaction do we have access to that information.  You should consult the payment processors’ policies to learn more about how those companies process bank account and credit and debit card transactions for us. 

THIRD-PARTY SELLERS

Peter Pan partners with a number of third-party agents and aggregator websites (collectively, Third-Party Sellers) who sell transportation services for Peter Pan coach buses.  Third-Party Sellers share your Personal Information with Peter Pan in accordance with the policies of the Third-Party Sellers posted on their websites in order to complete your ticket purchase and enable Peter Pan to deliver Services to you. You should consult the Third-Party Sellers’ policies to learn more about how those companies process your Personal Information, and please note that any Personal Information shared by Third-Party Sellers with Peter Pan will be handled by Peter Pan in accordance with this Privacy Policy.  

YOUR COMMUNICATION WITH US

We collect information when you communicate with us.   The specific types of information we collect will depend on the forum in which you communicate with us.  For example, if you send us an email, we will collect your email address and the content of your email.

INFORMATION WE AUTOMATICALLY COLLECT 

When you use our Websites or App, or the Internet Service we make available, we automatically receive and collect information from your device.  This information may include the following, as applicable:

• Information about your device, such as the operating system, hardware, system version, Internet Protocol (IP) address, device ID, and device language.
• Your country and general location, time zone, and language used.
• The specific actions that you take when you use our Websites, App, and/or Platform, including but not limited to the pages and screens that you view or visit, search terms that you enter, and how you interact with our Websites, App, and/or Platform.
• The time, frequency, connection type, and duration of your use of our Websites, App, and/or Platform.
• Information regarding your interaction with email messages, for example, whether you opened, clicked on, or forwarded the email message.
• Identifiers associated with cookies or other technologies that may uniquely identify your device or browser (as further described below).
• Pages you visited before or after navigating to our Websites.

AGGREGATE INFORMATION COLLECTED

Aggregate information is information that does not identify you.  Aggregate information may be collected when you use our Services, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only aggregate information remains.  We may collect, use, store, and transfer aggregate information without restriction (subject to applicable law).

EMPLOYMENT

If we or a third-party service provider have collected your Personal Information in response to a job opening posted on our Websites, you are giving us and third-party service providers engaged on our behalf permission to use, disclose, and retain your Personal Information for the purpose of evaluating your application for employment for the specific position that you applied to, as well as other roles at Peter Pan.  This Personal Information may be processed and stored by a third-party talent tracking solution provider as well as with vendors, consultants, and other service providers who need access to such information to carry out work relating to the recruitment process on our behalf.

COOKIES AND ANALYTICS

Like most websites, our Websites may use “cookies.” Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to help us identify you when you come to our Websites, to analyze our web traffic using an analytics package, to test content, and to store information about your preferences.

Overall, cookies will help us provide you with a better online experience by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This setting may prevent you from taking full advantage of the Websites.

We may use third parties, such as Google Analytics or other analytics providers, to analyze traffic to our Websites. Google Analytics does not create individual profiles for visitors and only collects aggregate data. We may also use cookies, pixels, beacons, or other web tracking technologies to track the amount of time spent on our Websites and whether or not certain content was viewed. We may work with a third party to collect and process this information for us, based on our instructions and in compliance with this Privacy Policy. 

Although we do our best to honor the privacy preferences of our visitors and users, we are not able to respond to Do Not Track signals from your browser.

HOW WE USE YOUR INFORMATION

Our use of your information (including any Personal Information) is subject to applicable laws regarding information use, disclosure, and retention. In general, however, we use information to provide our Services, operate Peter Pan’s business, partner with Third-Party Sellers, communicate with you, and provide products, services, and information that you request from us.  This includes but is not limited to the following:

• Providing, operating, improving, maintaining, and protecting our Services, including the safety and security thereof.
• Creating your Perks Account if you choose to register with us, and we use registration information to set up your account and to communicate with you.
• Sharing information with affiliates and third-party service providers in accordance with the terms of this Privacy Policy.
• Sending you updates, marketing communications, and other information about Peter Pan, our Services, and our products, promotions, and our Websites and App.
• Targeted advertising on third-party platforms and websites, and we may share your Personal Information with third-party service providers for the purposes of targeted advertising as defined by some data privacy laws.
• Providing personalized products and services to you.
• Enhancing or improving your user experience.
• Providing you with technical and other support.
• Sending you updates, communications, and other information about Peter Pan, our Services, and about products and services of third parties that we think you may be interested in.
• Sending you notices and alerts.
• Conducting research, analytics, and monitoring and analyzing trends and usage for our Services.
• Contacting you and responding to your inquiries.
• As necessary to comply with any applicable law, regulation, subpoena, legal process, or governmental request, including but limited to any requests from state departments of transportation.
• Enforcing contracts, including investigation of potential violations thereof.
• Detecting, preventing, or otherwise addressing fraud, security, or technical issues.
• Protecting against harm to the rights, property, or safety of Peter Pan, our users, or the public as required or permitted by law.

HOW WE SHARE YOUR INFORMATION

We do not rent or sell your Personal Information.

We share information, including Personal Information, in certain circumstances with third parties through operation of our Services.  Below we explain when that happens.  We also disclose information and Personal Information when required by applicable law.

SERVICE PROVIDERS

We may transfer Personal Information to third parties for the purpose of providing the Services or operating our business.  For example, we may transfer your Personal Information to non-affiliated third-party service providers to assist with providing the Services to you.  Third-party service providers operating our Websites, App, and the Internet Service we make available may also collect Personal Information from you directly, such as when you set up a Perks Account, provide information to one of our payment processors to purchase a ticket or Peter Pan merchandise, or when you are asked by the hosting provider of the Internet Service to provide an email address in order  to sign-in and access the Internet Service.  Service Providers sometimes share your Personal Information with us in order to provide us and you their products and services.

REQUIRED TRANSFERS

We may also transfer your Personal Information to third parties under the following circumstances: (i) to comply with a legal requirement, law, subpoena, judicial proceeding, court order, governmental request, or legal process; (ii) to investigate a possible crime, such as fraud or identity theft; (iii) when we believe it is necessary to protect the rights, property, or safety of Peter Pan or other persons, or (iv) as otherwise required or permitted by law, including any contractual obligations of Peter Pan.

AS DIRECTED BY YOU AND WITH YOUR CONSENT

We also share Personal Information with companies, agencies, organizations, or individuals outside of Peter Pan at your direction or when we have your consent to do so. 

HOW DO WE PROTECT YOUR INFORMATION

We take the security of your Personal Information very seriously.  We use reasonable administrative, physical, and technical safeguards to secure the Personal Information you share with us.  Despite these safeguards and our additional efforts to secure your information, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information.

THIRD-PARTY WEBSITES

The Services may contain hyperlinks to websites operated by third parties, which may include social media features, such as social media buttons or links.  We provide such hyperlinks for your reference and convenience only.  We do not control such websites and are not responsible for their content or the privacy or other practices of such websites.  It is up to you to read and fully understand their privacy policies.  Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites.  If you are submitting information to any such third party, you should review and understand that party’s applicable policies, including their privacy policies, before providing your information to the third party.

INTERNATIONAL VISITORS

We operate the Services and our business from the United States. If you use our Services from other regions of the world with laws governing data collection and use that may differ from the laws of the United States, then please note that by sending an email or other communication containing Personal Information or by providing Personal Information to us through our Services, you are assuming the risk of doing so and are voluntarily transferring your Personal Information outside of those regions to the United States and other countries.

privacy FOR MINORS

Our Services are not intended for use by persons under the age of 13 and we do not knowingly collect Personal Information from minors under the age of 13 in connection with the Services.  

CHANGES TO OUR PRIVACY POLICY

Peter Pan may change, modify, add or remove portions of this Privacy Policy (each, an “Update”) at any time and in our sole discretion without prior notice to you, and such Updates will be effective immediately. If Peter Pan makes Updates to this Privacy Policy, Peter Pan will change the “Last Updated” date above and make reasonable efforts to provide notice to you about material changes.  Your continued use of the Services will confirm your acceptance of the updated Privacy Policy.  Peter Pan encourages you to frequently review the Privacy Policy to ensure you understand the latest terms and conditions associated with use of the Services.  If you do not agree to the current Privacy Policy, you must discontinue using the Services.
