            Peter Pan Bus Lines, Inc. (PPBL) reserves the right to update these terms and conditions at any time.  Your continued use of the PPBL website (www.peterpanbuslines.com) (the “Site”) means that you accept those changes. 

            The Site is protected by copyright under the United States and foreign laws.  Title to the Site remains with PPBL.  Any use of the Site not expressly permitted by these terms and conditions is a breach of these terms of conditions and may violate copyright, trademark and other laws.  The Site and its features are subject to change or terminate without notice in the editorial discretion of PPBL.  If you violate any of these terms and conditions, your permission to use the Site automatically terminates.

            The Site is being presented for your individual and business use.  PPBL grants to you a non-exclusive non-transferable, non-sublicensable, limited right and license to access the Site, and to use the Site and its resources for travel accommodations.

            No Reproduction of Materials.  The materials on the Site are protected under state and federal copyright and trademark law. By accessing and using the Site, you do not obtain any ownership interest or rights to the material found on the Site, nor are you permitted to copy or create any derivative works of using any portion of the material. All rights to the content of the Site, or the right to access the content or material thereon, automatically terminates along with the permission or license granted by us hereunder. Copyright and trademark infringement are violations of federal and state law and are subject to criminal and civil penalties.  In the event of any confusion as to the use of the Site, please contact PPBL for clarification.

 

 

            Liability of PPBL and its Licensors.  The use of the PPBL Site is at your own risk. 

            When using the PPBL Site, information will be transmitted over a medium which is beyond the control and jurisdiction of PPBL.  Accordingly, PPBL assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the PPBL Site.

            The PPBL Site is provided on an “as is” basis.  PPBL and its licensors, to the fullest extent permitted by law, disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties’ rights and fitness for a particular purpose.  Specifically, PPBL makes no representations or warranties as to the accuracy, reliability, completeness, currentness or timeliness of the materials, text, graphics, links, or communications provided on or through the use of the Site.

            In no event, shall PPBL, its licensors or any third parties mentioned on the PPBL Site be liable for any damages, including without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from the use or inability to use the Site, whether based on warranty, contract, tort or any other legal theory, and whether or not PPBL is advised of the possibility of such damages.  PPBL is not liable for any personal injury, including death, caused by the use or misuse of the Site or the services provided. 

            No Unlawful or Prohibited Use/Intellectual Property.  You are granted a non-exclusive, non-transferrable, revocable license to access and use the Site strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to PPBL that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

            All content included as a part of the Site, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of PPBL and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

            You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site.

            General Restrictions.  You may not transfer, copy or display the Site or its content, except as permitted herein. In addition, you may not sell, rent, lease, distribute, broadcast, sublicense or otherwise assign any right to the Site or its content to any third party.   You may not attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management system used as part of the Site for any commercial or illegal purpose.

            User Submissions.  You agree that you will not upload or transmit any communications or content of any type that infringes or violates any rights of any party.  You agree that any such submission is non-confidential for all purposes.  If you make such submission, you are  warranting  that the owner of such content has expressly granted PPBL a royalty-free, perpetual, irrevocable, world-wide non-exclusive right to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any media or medium, or any form or format  now known or hereafter developed. 

            PPBL Electronic Communications.  Visiting the Site, inputting information and  sending emails to PPBL constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

            PPBL reserves the right but is not obligated to do any or all of the following:

  1. Investigate the allegation that a communication does not conform to the terms of this Agreement;
  2. Remove communications which are abusive, illegal or disruptive and otherwise fail to conform with these terms and conditions;
  3. Terminating user’s access to any of the Site entirely upon any breach of these Terms and Conditions;
  4. Monitor, edit or disclose any communication on the Site;
  5. Edit or delete any communication posted on the Site, regardless of whether or not such communication violates the standards.

            PPBL reserves the right to take any action it deems necessary to protect the personal safety of our employees or the public.  PPBL has no liability or responsibility to users of the PPBL Site or any person or entity for performance or nonperformance of the aforementioned activities.

            Advertising and Links to Other Sites.  PPBL does not endorse the content of any third-party website.  PPBL is not responsible for the content of links, third-party sites, sites framed within the PPBL Site or third-party advertisements and does not make any representations regarding their content or accuracy. PPBL currently uses, Transcor Data Services which is independently certified annually for data security.   Your use of third-party websites is at your own risk.

            Indemnity.  You agree to defend, indemnify and hold PPBL, its officers, directors, employees, agents, licensors and suppliers harmless from and against any claims, actions or demands, liabilities and settlements, including without limitation reasonable legal and accounting fees resulting from or alleged to result from your use of the Site.

            These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts, without respect to its conflicts of law principles.  If any provisions of these Terms and Conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.  No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

SCOPE:
This policy is designed to inform you of the Peter Pan Bus Lines, Inc. (PPBL) policy regarding the collection, use and disclosure of information we receive from users of the Site. By using the Site, you agree to the collection and use of information in accordance with this policy. PPBL may disclose information received from users where PPBL reasonably believes that disclosure of such information is necessary to comply with law (including court and government orders, and civil subpoenas) or to PPBL’s agents and advisors so that they may provide their services to PPBL, and only under strict confidentiality restrictions.

 

INFORMATION COLLECTION, USE, AND SHARING:
Personal Information:
When using the Site, you may provide us with certain personally identifiable information that can be used to provide travel services to you. Personal identifiable information may include, but is not limited to your name, address, telephone number, email address, or any other information deemed necessary to provide the services.

Audio/Video Content:
Any audio or video content on the Site is for marketing and promotional purposes only and may not be duplicated by visitors. 

SECURITY:
We take precautions to protect your information. When you submit sensitive information via the Site, your information is protected both online and offline. Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser or looking for “https” at the beginning of the address of the web page. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment. PPBL currently uses, Transcor Data Services which is independently certified annually for data security.   

 

PPBL recognizes the importance of protecting our users’ privacy. To that end we have created this privacy statement in order to demonstrate our commitment to privacy. Information on how Site content can and cannot be used is also listed below. Please note that laws and regulations above and beyond PPBL ‘s policies may apply to commercial electronic messages sent to individuals who have elected to list their contact information on the PPBL website. PPBL strives to comply with all privacy laws.

WHAT INFORMATION IS COLLECTED

PPBL and its Web hosting company, acting as PPBL’s agent, collect and store technical information about your visit to our website. We use this information for statistical purposes to make our Site more accessible to visitors and the information we collect is not provided to any other third party. Specifically, we may record:

  • The name of the domain from which you access the Internet.
  • The Internet address of the website from which you linked directly to our Site, if any.
  • The type of Web browsing software and operating system you are using to view our Site.
  • The date and time you access our Site.
  • The pages you visit on our Site.
  • The amount of time spent on the Site.

These forms typically ask for contact information (such as your phone, address or e-mail address), financial information (such as your credit card numbers), and demographic information (for example, company product categories, areas of interest, location, etc.) Contact information from these forms is used to send education, training, research projects, best practices studies, or other information that you request.

HOW INFORMATION COLLECTED IS USED

Demographic and profile data collected at our Site may be added to a database maintained by PPBL to customize your website experience. It may be used to contact users of the Site for online surveys or advocacy purposes if the user has indicated an interest. No personal information is ever shared or sold to a third party.

LINKS TO OTHER SITES

The Site may contain links to other Sites. PPBL is not responsible for the privacy practices of such websites. Our Site may make list servers and Web forums available to its users. Any information that is disclosed in these areas becomes public information, and you should exercise caution when deciding to disclose personal information.

SECURITY

Our Site uses physical, electronic and managerial procedures to protect information collected online including firewalls to protect the loss, misuse and alteration of the information under our control. The use of these security measures is not a guarantee that information supplied over the Internet will not be intercepted. Peter Pan Bus Lines, Inc. (“PPBL”) is a Massachusetts corporation dedicated to travel accommodations, namely,  safe bus and coach travel services to individuals and groups.   

 

Recent legislation and attention in the U.S. on data privacy has been focused on the collection of personally identifying information (PII) by businesses and organizations, the right of consumers to share or not share that information, and how PII can be used by third parties. Any personally identifying information contained in data that PPBL processes and aggregates was collected by PPBL clients. Therefore, PPBL’s data privacy focus is limited to describing to clients the precautions, systems and protections utilized by the company to bring in and store data, and prevent unauthorized data access; to make transparent the security and privacy services/systems utilized; and to demonstrate company compliance with PPBL’s own data security and privacy controls. And finally, this policy addresses PPBL’s approach to data disposal and data breach disclosure.

 

PPBL annually retains legal counsel specializing in data privacy to review this Data Security and Privacy Policy, as well as PPBL’s internal Data Security Controls. This consistent review helps ensure that PPBL and its clients’ data security risks are mitigated.

 

  1. Personally Identifying Information

 

Protecting information that could be used to identify an individual’s identity is of primary concern politically, socially and legislatively today. As described above, this information is referred to as Personally Identifying Information, or PII.

PII is categorized as either Non-Sensitive PII or Sensitive PII. Non-Sensitive PII makes it possible to identify, contact, or locate a single person. For example, names, addresses, phone numbers and email addresses constitute Non-Sensitive PII. When Non-Sensitive PII is combined with other information it is possible to construct behavioral profiles of individuals and groups of individuals that can be used for analysis and marketing purposes.

 

Sensitive PII is currently defined by the Federal Communications Commission (FCC) as credit card numbers, financial account numbers, government issued ID numbers, health information, or information regarding children. Both federal and state-by-state laws exist to regulate the collection and storage of this information. PPBL does not store any Sensitive PII.

The objective of PPBL’s Data Security and Privacy controls are intended to mitigate against the risk of a data breach that could result in PII being stolen and used for unauthorized purposes.

 

 

  1. Data Collection

 

The data collected by PPBL client organizations includes non-sensitive PII, such as names and addresses, as well as purchase transaction information. The majority of this information is collected and immediately stored in a system [owned or leased by the client]. It is the responsibility of the collecting organization to govern end user privacy and security processes, based on applicable federal and state laws.

 

Note that while not all states require privacy policies, the FTC has determined that if an organization has a privacy policy or otherwise makes representations to consumers related to the treatment of consumer data, that policy or representation must be followed. If it is not, the behavior constitutes an unfair business practice.

 

Related to the subject of data collection is the transportation or transmission of collected data. PPBL requires its partners to utilize its secure data transmission process to protect against the risk of data theft during the file transport process. This method eliminates the need for the common, unsecure practice of attaching data files to emails for transmission.

 

Clients send data to PPBL via SFTP (Secure File Transfer Protocol). SFTP is based on SSH (Secure Shell), which is a network protocol that allows data to be exchanged using a secure channel between two networked devices. PPBL also employs a robust firewall to protect data and software assets.

 

PPBL participates in Google’s Remarketing online marketing program to present online advertisements to PPBL web site visitors who visit other, non- PPBL web sites. Google’s Remarketing is a feature that enables PPBL to reach people who have previously visited our website. Ads can be shown to these customers when they visit other websites in the Google Display Network or when they search on Google using PPBL’s keywords. The advertisements provide visitors information about PPBL. PPBL’s implementation does not collect any personally identifying information, just the basic IP address information used to identify visitors from PPBL. No sensitive PII is collected or used in this process. Google utilizes cookies to collect and store IP and visit information. You may opt-out of Googles use of cookies by clicking here.

 

  1. Data Storage

 

Data stored on computer storage devices is subject to a variety of data security risks. These include unauthorized access to the actual computers and the physical data center where the computers are located, as well as safe handling of data backup media.

 

Data Center Security

PPBL provides a physically secure data center where the computers, network equipment, source software and data storage media are located. Best practice security controls are utilized to ensure that only authorized individuals have access, all access is logged and access to the data center is recorded with video surveillance, 7 x 24 daily. The data center room itself is located within a building that employs 7 x 24 security personnel, card key access, and multiple secure locking access points. PPBL currently uses, Transcor Data Services which is independently certified annually for data security.   

 

PPBL also follows a secure data backup process to protect against unauthorized access to backup media and to ensure rapid recovery of client data in the case of multiple types of data loss or corruption. PPBL’s backup and recovery processes mitigate against risk of natural disasters including fire, earthquake, power loss, and floods. PPBL conducts full back ups nightly.  The data is retained in a secure environment for five years.  Other data storage risks that pertain to our production computer servers include:

 

 firewall protection

 login authentication

 secure network connections

 anti-virus and malware protection

 

 

 

Traveling Laptop Security:

In addition to data storage on PPBL computer servers located in its data center, PPBL consultants and staff work with client PII and transactional data on PCs and laptops. PPBL controls that mitigate the risk of stolen data from these sources include the use of a central file server where all client working files and final deliverables are located, as well as delivering to clients’ password-protected data files via portal laptops and removing the files immediately after client delivery.

 

  1. Data Use

 

Data Processing

PPBL processes client data by performing two primary services that enable its use for direct response campaigns and data analysis/research. The first service is name and address correction, often referred to as “data hygiene” or “NCOA (National Change of Address)”, which updates patron address information to current postal service standards. This process enables correct unique household identification. Name and address correction is performed by PPBL in-house, while a contracted service with a leading data services provider is used for national change of address corrections. PPBL’s contract with this provider assures this data is not used for any purpose other than the intended processing. When the cleaned data is returned to PPBL it is validated for record counts and stored within the secure data center.

 

PPBL also offers clients either self-service or PPBL-administered segmentation. This service aggregates patron data into manageable segments, making list creation, trades, and reports much simpler to work with.

 

As described in the Overview, PPBL retains rights to utilize aggregated data, which is stripped of PII. The aggregation process itself ensures that the risk of disclosing PII is removed.

 

 

 

  1. Data Disposal

 

PPBL will honor requests to remove from its data center PII and transaction data provided to PPBL for data services. The process utilized by PPBL removes names, addresses and the associations to transaction and organizational information. This enables PPBL to retain aggregated data for trend analysis while removing all data specifically related to an organization’s patrons.

 

PPBL’s process includes data removal from the following sources:

 

 PPBL databases that contain patron files. These currently include both eMerge and new Data Center databases.

 Data on database backup disks are cycled every 30 days, eliminating all previously backed up data.

 Client data product files. These may include working files, final analytics products, and presentations that include data.

 On or around desks of analysts and consultants assigned to the client project. Note that PPBL policy forbids the retention of paper output that includes client data. In some circumstances working reports are printed for internal meetings, which are identified and disposed of using a shredder.

 Consultant PC’s used for delivering client presentations are reviewed for any stored client presentations or reports, which are destroyed

 

Data disposal projects produce a final report that records the activities taken for the removal of each source listed above. This report is shared with the requesting organization and retained for PPBL’s records.

PPBL’s Data Disposal service requires a request in writing from the primary contact at the client or partner organization. Thirty days are needed to complete a full data disposal project.

 

  1. Data Breach Disclosure

 

Security breach is defined as an unauthorized acquisition of unencrypted computerized data that compromises the security, confidentiality, or integrity of PII maintained by an entity. In most US states statutes are in place that requires notification to consumers when an entity becomes aware of a data security breach.

 

If a PPBL security breach was to occur PPBL would immediately notify the affected organizations, provide a complete list of all patrons believed to have been compromised, and would work closely with organizations to satisfy notification obligations.

Contact information included on PPBL’s Site is not posted for the purpose of promoting/marketing products/services to agencies, but is primarily posted for the purpose of allowing agencies to connect with PPBL. All other email and electronic communications should adhere to the following principles:

  1. You should have a prior relationship with the person receiving your email. (Someone giving you their business card is acceptable in this regard–it implies permission to get in contact. Similarly, if someone has sent you an email.)
  2. A valid “from” and “reply to” address must be included with each message.
  3. If you have a subscription list, you should send a confirmation email that the person wishes to be on the list.
  4. There should always be a quick way to unsubscribe from any mail list.
  5. Any request to cease mailing from an individual or organization should be quickly honored.
  6. A complaint involving a breach of this policy may be considered a violation of the PPBL Code of Ethics, and therefore referred to the Board of Directors for their consideration. Should they find a breach occurred, remedies may be required. Sanctions may also be imposed such as suspending or terminating further business.

LOST AND FOUND POLICY

 

Peter Pan Bus Lines, Inc. is not responsible for personal property of any nature left behind or lost on the coach, in the terminal or in any terminal or on a charter stay. If we are able to find an item left behind,  Peter Pan Bus Lines, Inc. will ship it at the registered passenger’s expense to the registered passenger upon request. Shipping charges will be charged to the registered passenger once we are given a valid credit card number.  Items unclaimed will be held for a maximum of 14 days at which time Peter Pan Bus Lines, Inc. reserves the right to dispose of or donate the item(s) to a local charity in the discretion of Peter Pan Bus Lines, Inc.

 

Waiver of Liability Relating to Coronavirus/COVID-19

 

The novel coronavirus, COVID-19, is a worldwide pandemic.  COVID-19 including all variants,  is extremely contagious.  The virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air.  People reportedly can be infected and show no symptoms and therefore spread the disease.  The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19.

 

Peter Pan Bus Lines, Inc. (“PPBL”) cannot prevent its passengers from becoming exposed to, contracting, or spreading COVID-19 while utilizing PPBL’s services or premises.  It is not possible to prevent against the presence of the disease.  Therefore, if you choose to utilize PPBL’s services and travel with PPBL by boarding PPBL’s buses, coaches and entering its terminals, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.  PPBL has taken significant steps to comply with all safety precautions and exceed the known protocols of safety, including sanitizing and disinfecting all buses and developing contact free ticketing and boarding procedures.  PPBL has developed, adopted and published nineteen protocols for the safety of PPBL passengers and employees while traveling with PPBL.  Please see peterpanbus.com for details. ASSUMPTION OF RISK:  I have read and understand the above warning concerning COVID-19.  I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize PPBL’s services, travel on PPBL buses, coaches and enter its terminals.  These services are of such value to me and/or to my children that I accept the risk of being exposed to contracting and/or spreading COVID-19 in order to utilize PPBL’s services.

 

WAIVER OF LAWSUIT/LIABILITYI hereby forever release and waive my right to bring suit against PPBL and its owners, officers, directors, managers, officials, trustees, agents, employees, or utilizing PPBL’s services, buses, coaches and terminal premises.  I understand that this waiver means I give up my right to bring any claims against PPBL including for personal injuries, death, disease, lost wages, property losses, or any other loss, including but not limited to claims of negligence and I give up any claim I may have to seek damages against PPBL, whether know or unknown, foreseen or unforeseen.
