TERMS AND CONDITIONS FOR INTERNET SERVICE

Peter Pan Bus Lines, Inc. (“Peter Pan”) is pleased to offer its customers and passengers (“you” or “your”) access to this complimentary internet public access network (the “Internet Service”).  The Internet Service is provided by one or more third-party service providers (“Hosting Providers”) in conjunction with Peter Pan. As a condition of accessing the Internet Service, you must agree to the following terms and conditions (the “Internet Service Terms”). By accessing and/or using the Internet Service, you represent you have read and understand these Internet Service Terms and our General Terms of Service, you acknowledge these Internet Service Terms and our General Terms of Service govern your access to and use of the Internet Service using any electronic device, and you agree to these Internet Service Terms and our General Terms of Service.  

Changes to Internet Service Terms

Peter Pan may change, modify, add or remove portions of these Internet Services Terms (each, an “Update”) at any time and in our sole discretion without prior notice to you, and such Updates will be effective immediately. If Peter Pan makes Updates to these Internet Services, Peter Pan will change the “Last Updated” date above and make reasonable efforts to provide notice to you about material changes.  Your continued use of the Internet Service will confirm your acceptance of the updated Internet Service Terms.  Peter Pan encourages you to frequently review the Internet Service Terms to ensure you understand the latest terms and conditions associated with use of the Internet Service.  If you do not agree to the current Internet Service Terms, you must discontinue using the Internet Service.   

Security

You expressly acknowledge and agree that there are significant security, privacy, and confidentiality risks inherent in accessing or transmitting information through the Internet on a public access network. These security issues include the risk of transmissions being intercepted, loss of data, or the introduction of viruses or other programs that can damage your electronic computing device, software, or data. ACCORDINGLY, YOU AGREE THAT PETER PAN AND ITS HOSTING PROVIDERS ARE NOT LIABLE FOR ANY INTERCEPTION OF TRANSMISSIONS, LOSS OF DATA, HACKING, OR DAMAGE TO YOUR ELECTRONIC COMPUTING DEVICE, SOFTWARE, OR DATA THAT RESULTS FROM USING THE INTERNET SERVICE.  YOU ARE SOLELY RESPONSIBLE FOR SECURING YOUR ELECTRONIC COMPUTING DEVICES, SOFTWARE, AND DATA, AND PROTECTING THEM FROM VIRUSES, WORMS, MALWARE, TROJAN HORSES, AND OTHER HARMFUL CODE.

Please notify Peter pan immediately if you suspect, detect, or experience any security issues when accessing and/or using the Internet Service. 

Information Privacy

Peter Pan respects the privacy of all users of the Internet Service and will only use personal information provided by you in connection with the Internet Service, such as your email address for sign-in purposes, and information collected about your usage of the Internet Service, in accordance with Peter Pan’s Privacy Policy, which is available here.

 

 

Restrictions on Use of the Internet Service

You agree to not use the Internet Service to: (a) engage in any unlawful acts or activities or transmit any material that is unlawful, threatening, abusive, harassing, tortious, defamatory, obscene, libelous, invasive of another’s privacy, or racially, ethnically or otherwise objectionable; (b) harm, or attempt to harm, minors in any way; (c) impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; (d) transmit any material that you do not have a right to make available under any law or that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party; (e) transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” or any other form of solicitation; (f) transmit any material that contains software viruses or any other harmful computer code, files, or programs; or (g) use the Internet Service for excessively high volume data transfers.

Parental Control

Peter Pan does not review nor exercise any control over the content or materials made available over the Internet by third parties, including without limitation any electronic mail transmissions. Please be aware that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material on the Internet that is harmful to minors.

Disclaimer of Warranties

THE INTERNET SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER PETER PAN NOR ITS HOSTING PROVIDERS MAKE ANY WARRANTY OR REPRESENTATION AS TO THE RELIABILITY, ACCURACY, OR USEFULNESS OF THE INTERNET SERVICE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PETER PAN AND ITS HOSTING PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PETER PAN AND ITS HOSTING PROVIDERS DO NOT WARRANT THAT THE INTERNET SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, OR THAT SOFTWARE DEFECTS WILL BE CORRECTED, OR THAT THE INTERNET SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.  

Limitation of Liability; Indemnification

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL PETER PAN OR ITS HOSTING PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA, OR OTHER INTANGIBLES, EVEN IF PETER PAN OR ITS HOSTING PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM THE USE OR THE INABILITY TO USE THE INTERNET SERVICE, FROM ANY CHANGES TO THE INTERNET SERVICE, OR FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.

YOU EXPRESSLY AGREE THAT NEITHER PETER PAN NOR ITS HOSTING PROVIDERS ARE RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE, TORTIOUS, OR ILLEGAL CONDUCT OF YOURS OR OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER’S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS, ARISING ON, FROM, OR IN CONNECTION WITH THE INTERNET SERVICE. YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN CONDUCT IN USING THE INTERNET SERVICE AND WILL INDEMNIFY AND HOLD HARMLESS PETER PAN AND ITS HOSTING PROVIDERS FROM ANY CLAIMS, LIABILITY, DAMAGES, OR COSTS THAT RESULT FROM YOUR CONDUCT AND ACTIVITIES WHEN USING THE INTERNET SERVICE.

IF YOU ARE DISSATISFIED WITH THE INTERNET SERVICE, OR WITH ANY PROVISIONS IN THESE INTERNET SERVICE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE INTERNET SERVICE.

Miscellaneous

These Internet Service Terms, together with the General Terms of Service and our Privacy Policy, constitute the sole agreements between you and Peter Pan for your use and the provision of the Internet Service, and the subject matter hereof. The section titles in these Internet Service Terms are for convenience only and have no legal or contractual effect.  Should any provision of these Internet Service Terms be held invalid or unenforceable, such provision will be modified to the extent necessary to render it enforceable without losing its intent or severed from these Internet Service Terms if no such modification is possible, and other provisions of these Internet Service Terms will remain in full force and effect. A waiver by either party of any term or condition of these Internet Service Terms or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. These Internet Service Terms and any rights and licenses granted hereunder, may not be transferred, delegated, or assigned by you, but may be assigned, delegated, or transferred by Peter Pan without restriction. Any attempted assignment, subcontract, delegation, or transfer by you in violation of the foregoing will be null and void. These Internet Service Terms shall be binding upon and inure to the benefit of each of the parties and the parties’ respective successors and permitted assigns.
