Charter Service Terms and Conditions

Thank you for choosing Peter Pan Bus Lines, Inc., (Peter Pan Bus Lines or PPBL), for your charter service transportation needs. We have more than ninety years of hands-on experience in the ground transportation industry and are committed to providing you with a safe, first-class transportation experience. This document sets forth the terms and conditions of the agreement between you (the "customer" or "you") and Peter Pan Bus Lines relative to the charter services that you have requested. By utilizing PPBL services, you agree (on behalf of yourself and your guests, heirs and invitees) that you understand the effect of the terms and conditions and you agree to be bound by the terms and conditions.

To ensure the highest levels of customer service, we will assign you a project manager within 48 hours after receipt of your confirmation. To track, pay, or make changes to your itinerary, please use our online system at www.peterpancharters.com. If you have additional questions, please contact charters@peterpanbus.com.

1. Payment Policy

General. Peter Pan Bus Lines requires you to be 21 years or older and have a valid U.S. credit card to hold and secure your reservation if you are paying by credit card. Once you have agreed to the terms and conditions (whether or not you have made a deposit), you are responsible for the cost of your charter, pursuant to our cancellation policy. Peter Pan Bus Lines requires a cardholder's signature, without this your reservation will not be processed but you will still be responsible for all cancellation fees. Your credit card will be charged based on the payment schedule displayed during your booking process. Peter Pan Bus Lines also accepts wire transfers, ACH payments, certified checks, business checks, personal checks and money orders. Peter Pan Bus Lines is not responsible for any overdrawn bank fees. If you pay by check, you must give Peter Pan Bus Lines the right to authorize your credit card for the full amount of the charter rental. If the check is not received by the due date stated in your agreement, Peter Pan Bus Lines shall have the right to charge your credit card for the full charter cost. If your reservation is made within thirty (30) days prior to departure of your charter bus trip, you must pay by certified check, wire transfer, credit card or ACH Payment. If you make changes to your charter, at any time, which require the payment of additional fees, those fees must be paid when your change is confirmed. Only one discount can be applied to a charter, promo or coupons.

They cannot be combined.

Payment for Charter.

A deposit of $ 250.00 per bus for one day charters or $500.00 per bus for overnight charters will be due in our office NO LATER than two weeks after the date of reservation. Charters ordered less than 30 days from the date of the trip must be paid in full at the time of reservation.

Final payment for the charter service is due and payable at least 21 days in advance of the Charter Date. When making payment, please indicate on your check or other mode of payment the date of your trip and your Charter Order Number to ensure proper credit. MasterCard, VISA, Discover and American Express are accepted for deposits and final payments.All payments due to Peter Pan Bus Lines shall accrue interest at a rate of 1.5 (one and one-half) percent per month, commencing 30 (thirty) days after an invoice is issued or the payment is due.

PRICES ARE SUBJECT TO CHANGE: All prices quoted in the order confirmation are subject to change at the discretion of PPBL for the following reasons. PPBL will try not to increase prices by more than twenty percent (20%) per Charter.

(a) PRICE OF FUEL: If the price of diesel fuel increases by more than twenty percent (20%) between the date of the confirmation and the date of the charter, PPBL may increase the prices quoted in the confirmation by an amount equal to the percentage of increase in diesel fuel pricing.

(b) DAMAGE TO BUSES: The cost of repairing damage to buses resulting from guests of the Charter shall be charged to the Chartering Party and is payable to PPBL as soon as such cost is determined.

(c) UNUSUAL CLEANING: When the nature of the charter trip is such that a greater than normal amount of time and material will be necessary to clean the coach properly upon its return to the garage, PPBL may at its option, require additional cost to cover such additional time and materials.

(d) GOVERNMENT CHANGES: If there is a change in the federal, state or local laws or regulations between the date of the confirmation and the date of the Charter which result in material additional or increased expenses to PPBL to provide the charter services, PPBL may increase the prices quoted in the order confirmation.

(e) ADDITIONAL CHARGES. When, at the request of the customer ordering charter services, a change in service results in an increase in miles travelled or total hours from those specified on the charter service order, an additional charge may be added by PPBL to cover additional services. Tolls and highway

fees and all entrance fees will be separate and additional elements in the determination of any additional charges. PPBL will notify customer of any additional charges as soon as possible.

2. Gratuities

Gratuities are not included in your charter price nor are they mandatory; however, excellent service is customarily rewarded with gratuities at your discretion. The amount may be added to your invoice or paid to the driver directly.

3. First-Come, First-Served Policy

All Peter Pan Bus Lines charter services are reserved on a first-come, first-served basis. Peter Pan Bus Lines reserves the right to cancel your reservation if a requested vehicle is unavailable, has mechanical problems, or if you have not made all required payments by the agreed-upon dates. If your requested vehicle is unavailable, Peter Pan Bus Lines may seek alternative vehicles to accommodate your travel needs. If securing a replacement vehicle results in additional charges, you may accept the new vehicle and new rates or cancel the contract without incurring a cancellation fee.

4. Final Order Confirmation

Once your reservation is confirmed, Peter Pan Bus Lines will email you a charter confirmation. Any modifications or changes to the final confirmation must be made within 48 hours of receipt of the confirmation. Peter Pan Bus Lines shall not be required to honor any changes made more than 48 hours after final confirmation, including changes in pick-up times, locations, and type of vehicle. You may also incur change fees as documented below.

MULTI-DAY TRIPS: A detailed itinerary is required for all for multi-day trips. The final itinerary must be received at least fourteen (14) days prior to departure. Itineraries are subject to review by a safety officer of PPBL. Prices are subject to change based on the final itinerary. The Chartering Party is responsible for reserving and paying for hotel room(s) for the driver(s). Single rooms are required.

5. Cancellation Policy

The Cancellation Policy applies to all charter customers. Peter Pan Bus Lines must receive all cancellation requests in writing stating the charter number, departure date and reason for cancellation via email at charters@peterpanbus.com. Verbal cancellation requests will not be accepted. To be valid, a cancellation must be made by the person whose name appears on the contract. Charters are subject to cancellation by Peter Pan Bus Lines if payments are not made by the applicable due date.

Once you agree to terms and conditions, should you choose to cancel while your reservation is still in processing up to 7 business days after booking you will still be liable for a cancellation fee based on the cancellation policy.The customer must notify PPBL of cancellations as soon as possible. There will be no cancellation fee if the cancellation is made more than 21 days prior to the charter date. In that event, any monies due you will be fully refunded if there are no future bookings or balances owed. Please allow four (4) weeks for refund processing. Cancellations received less than 21 days from departure date, will be subject to cancellation fees outlined below.

6. Change Policy

Charter details: The charter order represents the details provided at the time of initial booking. It is the customer’s responsibility to contact our office as soon as possible but at least 3 weeks before departure with any changes to this original charter order. Otherwise, the original details provided (the pickup point, pickup times, destination(s), number of buses etc.) will be the details that PPBL will follow on the day of your charter.

WE RECOMMEND THAT YOU CALL OR EMAIL OUR OFFICE TO CONFIRM YOUR TRIP DETAILS.

If you make any modifications following the order to your itinerary affecting pickup and drop-off times, Peter Pan Bus Lines reserves the right to adjust the total cost of your charter to reflect the changes. All changes to your itinerary, including any revised pickup or drop-off times or locations, must be submitted to Peter Pan Bus Lines at least 7 (seven) business days prior to your charter departure date. No change or modification shall be valid unless and until approved by Peter Pan Bus Lines. Any requested changes will be subject to availability.All subsequent changes to your itinerary will incur a fee:

All subsequent itinerary changes made more than 5 days prior to departure date that do not affect times, stops or distance will incur a $75 (seventy-five dollar) change fee.All subsequent itinerary changes made 5 days or less before your departure date that do not affect times, stops or distance will incur a $100 (one hundred dollar) change fee.All time shall be rounded up to full hours and all mileage is on a round-trip basis.If you modify the vehicle that has been reserved for your trip, please note that pricing may change based on vehicle type and availability.

RESCHEDULING DATES: If you reschedule your date more than 7 days prior to your trip date, there is no fee to change the date as long as you are in compliance with the payment policy. Dates will not be rescheduled if deposit/final payments were due and not paid. If you reschedule less than 7 days prior to your trip date, a $ 250 alternate date fee will be charged.

Weather Related Rescheduling: If you reschedule your date due to severe winter weather conditions and notify our office at least 8 hours prior to departure, there will be no fee to reschedule, however, if you cancel the trip the cancellation and alternate date charges above will apply. If less than eight hours notice is given a mandatory $250.00 cancellation fee will apply whether the trip is or is not rescheduled. If the trip is cancelled while the vehicle is in route to the pickup location, a mandatory charge of 100% of the total charter price will apply.

7. Overtime

The time of arrival at a starting point, stopover point, destination, or return to point of origin cannot be guaranteed. Drivers are carefully selected and have instructions to drive at all times at a speed within the limits of the law and compatible with safe operation. Unusual road, traffic and weather conditions are beyond PPBL control.

DRIVER HOURS: Federal Department of Transportation safety regulations prohibit drivers to be on duty for more than fifteen (15) hours per day, ten (10) of which are for driving (including a 30 minute pre- and post-trip inspection). The driver must be given eight (8) consecutive hours off before he/she may resume his/her duties. In the event that it is necessary for PPBL to arrange for and hire a second driver to meet the charter and take over for the driver so as to avoid exceeding the safety regulations for drivers, PPBL reserves the right to charge the customer a fee of $250 for the second driver.Overtime is available at the drivers' and at Peter Pan Bus Lines' discretion. Your cost is based on the services detailed in your final confirmation and is subject to change in accordance with the actual itinerary. Overtime charges shall be assessed at:$95 (ninety five dollars) per half hour for 24 to 56 passenger coaches$175 (one hundred seventy five dollars) per half hour for limo buses and Sprinter Vans.

8. Food and Alcohol Policy

You must notify Peter Pan Bus Lines in advance if you plan to bring food or beverages on your coach. Peter Pan Bus Lines reserves the right to deny your request and/or to require an additional security deposit. No tap beer, smoking, sexual activity or use of illegal drugs are allowed on your coach at any time. Any alcohol consumption on a Peter Pan Bus Lines charter is subject to applicable laws and PPBL policy. Alcohol may not be consumed by or served to any passengers on your coach unless all passengers are twenty-one (21) years of age or older. Peter Pan Bus Lines and its employees reserve the right, in their sole discretion, to refuse service to or expel from a coach any member of your group whose conduct is deemed inappropriate or poses a hazard to other passengers, the driver or the vehicle. Peter Pan Bus Lines also reserves the right to terminate the charter bus trip at any time because of violation of food and/or alcohol policies. Peter Pan Bus Lines may exercise this right by dropping you off at your home, the nearest police station or any previously agreed upon location. You may not bring or possess glass containers or kegs on the coach at any time. Peter Pan Bus Lines reserves the right to assess an additional surcharge for a cleaning fee, should the cleanup time be more than customarily required:The cleaning of vomit or other bodily fluids is a health and safety issue for subsequent passengers—you will be assessed a $250 (two hundred fifty dollar) service charge each time vomit or other bodily fluids must be cleaned up or removed.You will be assessed a $200 (two hundred dollar) service charge for every instance that spilled alcoholic beverages must be cleaned up or removed.You shall be responsible for any and all damage to the vehicle caused by any member of your group. The amount of the repairs will be assessed once a damage estimate has been obtained.Peter Pan Bus Lines does not allow any clients to visit multiple establishments that serve alcohol (bar hopping). In the event of a violation of this policy during a charter, Peter Pan Bus Lines shall prohibit alcohol on the coach during the duration of the charter. If any charter breaches these terms and conditions, the contract holder will be liable for any fines and charges and may conclude in the termination of the trip. By signing this agreement, you are hereby acknowledging that you will conform with these policies.

9. Special Requests

Peter Pan Bus Lines will do its best to accommodate special requests including but not limited to WiFi, power outlets, TV, Video, address systems, bathroom or other facilities and equipment.However, not all vehicles are equipped with every amenity. The failure of a vehicle to be equipped with specific amenities shall not be deemed an event of default by Peter Pan Bus Lines. This exemption shall not apply to specific requests for ADA accessible vehicles.

10. Amenity Assurance

You have the right to a coach where all amenities function properly. If any amenity on your charter bus malfunctions (including heat or air conditioning, restroom facilities, ADA Lifts.) Peter Pan Bus Lines will endeavor to either fix the problem or provide you with a replacement

bus with as little disruption to your itinerary as possible. In addition, you may be entitled to a credit up to 5% of the total charter cost for the amenity that was not functioning.

11. Baggage, Lost Items

The following items are prohibited from all baggage (both carry-on and baggage stored in the bus baggage compartment): • Acids • Alcoholic beverages or liquor (including beer, ale and wine) • Ammunition • Animals, pets (see note below*) • Articles exceeding baggage size limitations • Backpacks, baggage or other items with attached or protruding articles • Batteries containing liquid acids • Combustible liquids • Corpses or ashes of cremated corpses • Cylinders containing compressed gases • Explosives • Films – flammable • Firearms, all types • Fireworks • Flammable items • Furniture • Gases • Hazardous (dangerous) articles • Live fish, poultry, reptiles • Matches, strike-anywhere • Materials that have a disagreeable odor • Merchandise for resale (except sample baggage) • Phonograph records • Poisons • Radioactive materials • Television sets • Weapons (includes toy and replica weapons) The following additional items are prohibited from baggage stored in the bus baggage compartments – these items should only be stored in carry-on baggage: • Jewelry • Laptop computers • Money • Passports • Perishable items, including foodstuffs • Prescription medication (doctor prescribed) – must be kept in the possession of the passenger at all times • Service animals, assisting a passenger with a disability, are permitted on board

12. Mechanical Issues

Peter Pan Bus Lines does not guarantee a refund in the event that your trip is affected by mechanical or service issues and shall retain, at its sole discretion, the right not to refund. If a vehicle supplied by Peter Pan Bus Lines develops or experiences mechanical, electrical or other problems that render it inoperable, Peter Pan Bus Lines shall, at its sole discretion, provide you another vehicle, of similar quality and cost, to complete the charter. The replacement vehicle shall satisfy Peter Pan Bus Lines' contractual obligation. There shall be no refund when an alternate vehicle is provided. In the event that one or more electrical systems, including climate control, restroom facilities, radio, television, GPS or other electronic devices, shall malfunction, Peter Pan Bus Lines' sole liability in such an instance shall be limited to 5 (five) percent credit of the total cost of the charter. Credits are good for 1 year after the release form is signed and shall only apply to future charters with Peter Pan Bus Lines. Should Peter Pan Bus Lines be solely responsible for a delay or failure to meet time requirements, other than as a result of weather, road, traffic conditions or other causes outside of the control of Peter Pan Bus Lines, Peter Pan Bus Lines' liability shall not exceed twenty percent of the total charter cost. EQUIPMENT: Equipment furnished by PPBL is thoroughly inspected before being assigned to the charter to insure uninterrupted service. If for some reason beyond the control of Peter Pan Bus Lines a mechanical failure makes necessary the replacement of a bus originally assigned to the charter service, the replacement bus may be of a different type. DVD equipment is installed on our entire fleet. Requests for DVD equipped coaches will be honored to the best of our ability, however, there is no guarantee of a DVD equipped coach. Only non-copyrighted videos are permitted to be shown on Peter Pan Bus Lines coaches. The following is important information from a Summary Statement prepared by the Film Security Office of the Motion Picture Association of America Inc. provided for your information: By law, DVD’s available in stores throughout the United States are for HOME USE ONLY. The U.S. Copyright Act grants to the copyright owner, the EXCLUSIVE rights among others, to perform the copyrighted work publicly, (U.S. Code Title 17, Sections 101 and 106). Even performances in semipublic places such as clubs, lodges, factories, summer camps, and schools are public performances subject to copyright control. Companies, organizations and individuals who wish to publicly exhibit copyrighted motion pictures and audio visual works MUST secure a license to do so. PPBL DISCLAIMS ANY AND ALL LIABILITY FOR THE SHOWING OF DVD’s. This requirement applies EQUALLY to profit making organizations and non-profit institutions such as hospitals, prisons, schools, and the like. Purchases of prerecorded video discs does not change this provision. In addition, public performance of DVD recordings made from televised motion pictures is a multiple copyright infringement.

13. State Of Emergency Cancelation

If charter is canceled due to a state of emergency Peter Pan Bus Lines will offer a credit on a future trip. This credit will be good for 1 year or a cash refund.

14. Refund Policy and Post Charter Concerns

All refund requests must be consistent with the terms and conditions set forth herein and must be submitted in writing at charters@peterpanbus.com. All request or complaints must be filed within 30 days of your charter completion. When submitting a refund request, please use your charter order number as your reference number. Should any dispute, claim, question, or disagreement ("disputes”) arise related in any way to this agreement or any alleged breach of this agreement, the parties agree to consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. In the event there is a disruption or issue in your service, you agree to give Peter Pan Bus Lines up to 14 business days to do a full investigation of the matter with all parties (including but not limited to; you, the driver, the affiliate, the dispatch team, the customer service team, reservationist) and to work with you to come to an amicable agreement. If a mutually acceptable resolution cannot be reached within 60 calendar days of the original notice to the other party, all disputes shall be resolved through the American Arbitration Association ("AAA"), located in Springfield, Massachusetts in accordance with the provisions of its Commercial Arbitration Rules, and its Supplementary Procedures for Consumer-Related Disputes. The party filing the request for arbitration shall be solely responsible for the first $500 (five hundred dollars) in costs assessed for such arbitration. Any party who attempts to resolve a dispute without first filing for arbitration as set forth herein shall be responsible for any legal fees incurred by the other party to resolve the dispute.

Refunds on cancelled charters may not be issued for up to 120 days after the date of cancellation. All refunds shall be issued in the same form of payment as received. All credits to be applied to any future charter must be used within one year of the date those credits were issued.Please contact Peter Pan Bus Lines customer service at charters@peterpanbus.com to discuss any concerns that arise after your trip.

15. General Policies

Violation of any of these policies will result in immediate cancellation of the charter by PPBL.Peter Pan Bus Lines reserves the right to lease equipment from other companies to meet any of the obligations set forth herein.Customer shall make all reservations for any additional services that may be required, including overnight accommodations for drivers, special event permits, ferry service, onboard catering or meals. Parking fees are your responsibility and are not included in the cost of your charter. You are required to pay any necessary parking or other permit fees upon arrival, as required. Examples include stadium, concert, national park and theme park fees, as well as any other fees any jurisdiction may charge a bus to enter.If Peter Pan Bus Lines is unable to perform the obligations required under this contract and is unable to provide replacement transportation (which Peter Pan Bus Lines shall select at its sole discretion), Peter Pan Bus Lines' liability shall not include any responsibility for incidental, consequential or special damages, whether foreseeable or not. This shall include the costs of securing substitute and/or additional transportation; spoiled food and/or beverages; concert, theater, sports and/or other event tickets; admissions cost, reservations, plane or train tickets; and/or any and all other losses related to late pickup or no-show of requested transportation.Peter Pan Bus Lines retains the right to upgrade a vehicle in its sole discretion.All problems with any charter in progress, whether mechanical or otherwise, must be called in to the Peter Pan Bus Lines at (800 243-9560). Failure to notify PPBL while the problem is occurring will absolve Peter Pan Bus Lines from responsibility arising from such issues.If a Peter Pan Bus Lines bus arrives at the scheduled pick-up location and no passengers board the vehicle within thirty minutes of that scheduled pick up time, Peter Pan Bus Lines reserves the right to immediately terminate the agreement and shall have no obligation to provide any refund. PPBL is not responsible for the safety of guests while off of the coach.Peter Pan Bus Lines shall not be liable for: Any items left on the vehicle, during or at the end of a trip. PPBL shall not be liable for any loss of time or experiences due to mechanical failure, inclement weather, or road conditions, including road repairs and accidents. PPBL is not responsible for other events, acts or incidences over which PPBL has no control.Customer understands and acknowledges that the trip type set forth in the final confirmation, incorporated herein by reference, shall be fully binding; and the liability of Peter Pan Bus Lines, as described under this paragraph, shall likewise be limited by the final confirmation.Any and all credits issued by Peter Pan Bus Lines expire within one year of the date the credit is issued. Peter Pan Bus Lines cannot guarantee the assignment of any requested drivers, vehicles or amenities.All trips which exceed 15 hours of on-duty time and or 10 hrs of drive time in a 24 hr period require the driver to have eight (8) hours of off-duty time. The customer shall bear all responsibility for ensuring that enough time is built into the travel to arrive at all venues as scheduled. Peter Pan Bus Lines shall not be liable for any incidental, consequential, or special damages, whether foreseeable or not, as a result of such delay. If changes are made to an itinerary after booking, Peter Pan Bus Lines reserves the right to deny changes and or update the price to reflect said changes. Peter Pan Bus Lines reserves the right to impose an additional fee of $200 per hour for on-duty time in excess of 15 hours and drive time in excess of 10 hours in any 24 hour period.Peter Pan Bus Lines requires a copy of the front and back of any credit card being used for payment of services rendered, as well as a copy of the driver's license of the cardholder, should the total cost of the charter exceed $3,000 (three thousand dollars).Peter Pan Bus Lines is not responsible for any travel disruptions caused by depots that have been put out of service by the Federal Motor Carriers Safety Administration (FMCSA) because of safety or insurance reasons.Party bus seating capacity is measured from thigh to thigh, at an estimated 18-20 inches per seat. If you have passengers who cannot fit into that space, it may affect the seating capacity on your coach.No waiver of any provision of this contract shall be valid unless in writing and signed by the person against whom it is sought to be enforced. The failure of any party at any time to insist upon strict performance of any condition, promise, agreement or understanding set forth in this agreement shall not be considered or construed as a waiver or relinquishment of the right to insist upon strict performance at a future time.All refund/credit requests shall be reviewed by Peter Pan Bus Lines management. All requests for refunds or credit must be submitted no later than 30 days after the end of your trip.This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.The invalidity or unenforceability of any specific provision of this agreement shall not affect any other provisions, and this agreement shall be construed in all respects as if such invalid or unenforceable provision was omitted.The parties further agree that any and all disputes or claims arising out of or in connection with this agreement shall be resolved in the Commonwealth of Massachusetts, Superior Court, Hampden County.In the event Peter Pan Bus Lines is forced to incur collection costs to recover past due fees of any kind, Customer hereby agrees to compensate Peter Pan Bus Lines for any and all costs associated with such collection efforts, including the filing of a lawsuit, attorney's fees and costs for collection of such fees.Peter Pan Bus Lines will not charter/rent a vehicle with a customer unless that person is at least 21 years old.

OBJECTIONABLE PERSONS: The Company reserves the right to refuse to transport persons under the influence of intoxicating liquor or drugs, or who are, or are likely to become, objectionable to other persons.

CONDUCT OF PASSENGERS: Passengers shall not interfere with the operator in the discharge of his duty or tamper with any apparatus or appliance on the bus.Peter Pan Bus Lines Safety Department reserves the right to cancel your quote or charter for any safety concern.No firearms, no fireworks, no explosives allowed on coach or in baggage.Any minors must be accompanied by a legal aged chaperone based on your local state mandate or we reserve the right to cancel the trip.Peter Pan Bus Lines reserves the right and may deem necessary to require a $500 deposit (per vehicle) via credit card or wire prior to departure date. If deposit is not collected prior to departure, the charter will be canceled. All cancelation fees will apply. This deposit will be refunded after the return trip as long as no damage or excessive cleanup has been reported. Peter Pan Bus Lines also reserves the right to stop any charter/s mid-trip or cancel any charter/s due to safety and damage concerns.No decorations will be allowed on the exterior of the coach. No decorations will be allowed which interfere with the windshield or mirrors of the coach. No decorations with aromas, no candles, glass devices or containers, spiked shoes or clothing, fuel cannisters, lighter fluid, generators allowed on the coach.

ADA NOTICE. Any group which requires an ADA accessible bus is requested to inform us at the time of the reservation and must notify us no later than 48 hours prior to the charter’s departure.

COVID-19. PPBL has taken all required precautions relative to COVID-19. Passengers, by travelling with PPBL assume the risk of infection by COVID-19 or any disease.

Passengers agree as follows: I have read and understand the warning concerning COVID-19 and other communicable diseases. I hereby choose to accept the risk of contracting disease for myself and/or my children/charters group in order to utilize PPBL’s services, travel on PPBL buses, coaches and enter its terminals. These services are of such value to me and/or to my children that I accept the risk of being exposed to contracting and/or spreading disease in order to utilize PPBL’s services.

LIMITATION OF LIABILITY: NEITHER PARTY SHALL BE LIABLE IN ANY EVENT OR FOR ANY REASON, INCLUDING BREACH OF THIS AGREEMENT, EITHER DIRECTLY OR INDIRECTLY, TO THE OTHER PARTY OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR LOSS OF PROFITS ARISING OUT OF THIS AGREEMENT, EVEN IF SUCH DAMAGES WERE FORESEEABLE OR EITHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FORCE OF NATURE: Neither party shall be liable for failure or delay in performing obligations set forth in this agreement, and neither party shall be deemed in breach of its obligations, if such failure or delay due to natural disasters, strike, lock- out, or other industrial or transportation disturbances, law, regulation or ordinance, or any causes reasonably beyond the control of such party.

ENTIRE AGREEMENT: This Agreement constitutes the entire agreement between the parties and supersedes any and all other agreements, either oral or written with respect to the subject matter hereof.

NO ASSIGNMENT: The Customer may not assign this Agreement or any of their respective rights, interests, duties or obligations hereunder without the prior written consent of the other party. PPBL may assign this Agreement and any of its rights, interests, duties or obligations hereunder without the prior consent of the chartering party.

WAIVER OF LAWSUIT/LIABILITY: To the fullest extent permitted by applicable law, I hereby waive release PPBL, its owners, officers, directors, managers, officials, trustees, agents, employees, from any liability, claims, demands, or causes of action arising out of or relating to the agreement, except for acts of gross negligence or willful misconduct by PPBL. I understand that this waiver means I give up my right to bring any claims against PPBL including for personal injuries, death, disease, lost wages, property losses, or any other loss, including but not limited to claims of negligence and I give up any claim I may have to seek damages against PPBL, whether know or unknown, foreseen or unforeseen. I also understand that I am not waiving any claim against PPBL if the claim arises out of acts of gross negligence or willful misconduct by PPBL.

BY PROCEEDING TO BOOK A RESERVATION ELECTRONICALLY, I CERTIFY THAT I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND

WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.
